The Supreme Court of Missouri upheld the death sentence for Kevin Johnson on May 26 for murder in the first degree. Johnson had been originally been convicted in November 2007 for the shooting of Kirkwood Police Sgt. William McEntee on July 5, 2005. Johnson's defense lawyers were asking for an appeal when the Missouri Supreme Court released their opinion on the matter.
"The death sentence here is neither excessive nor disproportionate," read the opinion statement.
According to Johnson's defense, his violent act was a response to the way his brother's death was handled earlier in the day by police.
At the time of the shooting, McEntee was responding to a fireworks complaint. He was 43 and in his 19th year of service to the Kirkwood Police Department. Johnson's execution date is yet to be released.
